Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) govern your use of the services provided by KAAL SYSTEMS TECH SOLUTIONS & CONSULTING (“Kaal Systems”, “we”, “us”), a Technology Solutions & Consulting Office registered under the Municipality of Mogadishu (Dowladda Hoose ee Muqdisho) at Kaaraan District (Waaxda Jabuuti), Mogadishu, Somalia.

By messaging our WhatsApp number, creating an account, or otherwise using our services, you accept these Terms. If you do not accept them, do not use the service. If you are under the age of majority in your country, you may use the service only with the consent and supervision of a parent or guardian, who accepts these Terms on your behalf.

2. The services we provide

Kaal Systems provides:

• AI-driven educational tools, including BaroBot AI — a student learning assistant delivered over the WhatsApp Business Platform that answers curriculum questions in text and audio, in Somali and English, and provides interactive STEM practice.
• Custom AI and conversational bot development for organisations, including WhatsApp business assistants, AI automation and customer support engines.
• Cloud and systems architecture services, including serverless infrastructure, API gateway development and backend data pipelines.
• Technology and IT consulting, including digital transformation, business systems integration and bespoke software delivery.

Consulting and development engagements are additionally governed by a separate written statement of work. Where that document conflicts with these Terms, the statement of work prevails for that engagement.

3. Nature of educational output

BaroBot AI generates its answers using artificial intelligence. It is a study aid, not a substitute for a qualified teacher, a school curriculum, or professional advice of any kind. AI systems can be confidently wrong. You should verify anything you intend to rely on, particularly before an examination. We do not guarantee any academic result, grade or outcome.

4. Acceptable use

When using our services, you agree not to:

• use the service for anything unlawful, or to harass, threaten, defraud or harm another person;
• submit content that is abusive, hateful, sexually explicit, or that exploits or endangers a child;
• attempt to gain unauthorised access to our systems, probe or test their security, or interfere with their operation;
• use automated means to flood, scrape or overload the service, or resell access to it without our written permission;
• impersonate another person, or use someone else’s phone number or account without their permission;
• attempt to extract, reverse engineer or reproduce the underlying models, prompts or software behind the service;
• submit other people’s personal or confidential information without a lawful basis for doing so.

We may suspend or terminate access that breaches these rules, and where the law requires it, report unlawful conduct to the competent authorities.

5. Your account

Your account is tied to your WhatsApp phone number. You are responsible for activity that takes place through your number and for keeping access to your device secure. Tell us at info@kaalsystems.com if you believe someone else is using your account.

6. Subscriptions, billing and refunds

• Plans and prices are stated at the point of purchase, in the conversation or on this website, before you commit to pay.
• Billing is handled through mobile-money operators and other payment providers. Their own terms and fees apply to the transaction itself.
• Renewal. Subscriptions run for the stated period and renew only where you are told at purchase that they renew. You can cancel at any time by replying STOP or by emailing us; cancellation takes effect at the end of the period already paid for.
• Refunds. If the service was materially unavailable for a sustained period during your paid term, contact us within 14 days and we will issue a pro-rated refund or credit. Beyond that, fees for a period already used are not refundable.
• Price changes apply only from the next billing period, and we will tell you before they take effect.

7. Intellectual property

Our property. The service, including its software, models, prompts, interfaces, documentation, the name Kaal Systems, the BaroBot AI name and all associated branding, belongs to Kaal Systems and is protected by intellectual property law. These Terms grant you a limited, personal, non-exclusive, non-transferable licence to use the service for its intended purpose. They transfer no ownership.

Your content. You keep ownership of the questions, voice notes and other content you send us. You grant us the limited licence needed to process that content in order to deliver the service to you, as described in our Privacy Policy. We do not claim ownership of your content, and we do not use student content to train models for third-party use.

AI output. Subject to your compliance with these Terms, you may use the answers the service generates for you for your own study and work. AI-generated output may not be original to you and may be similar to output generated for others.

Client work. For consulting and development engagements, ownership of deliverables is set out in the applicable statement of work.

8. Third-party platforms

Our educational service is delivered over the WhatsApp Business Platform and depends on it. Your use of WhatsApp is also governed by WhatsApp’s own terms and policies. We are not responsible for the availability, behaviour or policies of WhatsApp, of mobile-money operators, or of any other third-party platform or network operator.

9. Availability and changes

We work to keep the service available, but we do not promise uninterrupted or error-free operation. Maintenance, network outages, platform changes by third parties and circumstances beyond our reasonable control can interrupt it. We may add, change or withdraw features. If we discontinue a paid service entirely, we will give reasonable notice and refund any unused portion of a prepaid subscription.

10. Disclaimer of warranties

To the fullest extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the output of an AI system will be accurate, complete or suitable for any particular purpose.

11. Limitation of liability

To the fullest extent permitted by law, Kaal Systems will not be liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of profits, revenue, data, goodwill, or academic or business opportunity, arising out of or connected with your use of the service — whether the claim is based in contract, tort or any other theory, and even if we were advised that such damage was possible.

Our total aggregate liability arising out of or relating to the service is limited to the greater of the amount you paid us for the service in the three months before the event giving rise to the claim or USD 50.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

12. Indemnity

You agree to indemnify Kaal Systems against claims, losses and reasonable costs arising from your breach of these Terms, your misuse of the service, or your infringement of another party’s rights.

13. Suspension and termination

You may stop using the service at any time by replying STOP, and you may request deletion of your data as described in our Privacy Policy. We may suspend or terminate access if you breach these Terms, if required by law, or if continuing to provide the service would expose us or other users to risk. Sections covering intellectual property, disclaimers, liability and governing law survive termination.

14. Governing law

These Terms are governed by the laws of the Federal Republic of Somalia. Any dispute that cannot be resolved between us will be subject to the jurisdiction of the competent courts of Mogadishu, Somalia. We ask that you contact us first — most issues are resolved without formal proceedings.

15. General

If any provision of these Terms is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms without our consent. These Terms, together with the Privacy Policy and any applicable statement of work, are the entire agreement between us regarding the service.
